Terms of Service

Effective August 13, 2026. This is the current version.

These terms govern your use of this website. They do not govern dental treatment, which is a separate relationship with its own paperwork.

Two other documents sit alongside these terms and are part of them: the Privacy Policy and the Medical Disclaimer, which covers the educational content, the before-and-after photographs and the reviews. The Accessibility Statement describes our accessibility practices and is not part of this agreement.

1. Agreement

By accessing peterbdmd.com you agree to these terms. If you do not agree with them, please do not use the site. The site is operated by Dr. Peter Bonifatto, DMD, individually ("we", "us"). It is intended for adults.

2. What this site is

An independent, personal website published by a practising dentist about his own work and his own views. It is a source of general information. It is not a patient portal, not a scheduling system, not a medical record, and not a substitute for seeing a dentist.

It is also not a website of Summer Dental & Orthodontics. Everything published here reflects Dr. Bonifatto's own opinions and not those of the practice, its owners, or any other clinician working there. Appointments, records, billing and administration are handled solely by the practice.

3. No doctor-patient relationship

Reading this site, or contacting the practice after reading it, does not create a doctor-patient relationship. That relationship begins only after an in-person clinical examination and a mutual, express agreement to proceed with treatment. Until then, nothing here is advice about you.

4. No medical or dental advice

Our Medical Disclaimer forms part of these terms and is incorporated into them. Read it. In short: everything here is general information, your mouth is individual, and no treatment decision should be made on the basis of a web page.

5. Ownership

All content on this site, including the text, the clinical photography, the illustrations, the design, and the underlying code, is owned by Dr. Peter Bonifatto and is protected by United States and international copyright law. Nothing on this site transfers any ownership or licence to you except as set out in section 6.

Patient photography is a special case. Before-and-after images are published under written authorizations given to Dr. Bonifatto by identifiable individuals for use on this site. Those authorizations do not extend to anyone else, for any purpose. Reusing a patient photograph from this site is not only copyright infringement, it takes an image of a real person outside the consent they actually gave.

6. What you may do

You may read the site, print or save pages for your own personal and non-commercial use, link to any page, and quote reasonable extracts of the text with clear attribution to Dr. Peter Bonifatto and a link back to the page you took it from.

Search engines and AI answer engines may crawl, index, retrieve, quote and cite the text of this site, subject to section 7 and to our robots.txt. That permission is given on purpose. We would rather these systems answer questions about Dr. Bonifatto accurately, from the source, than approximate it. When you quote clinical or treatment content, reproduce the stated risks, limits and candidacy requirements along with it.

7. What you may not do

You may not:

• Copy, republish, redistribute, mirror, adapt or display any patient photograph from this site, anywhere, for any purpose, commercial or otherwise. This includes reproducing it in search results, in an AI-generated answer, in a training corpus, in a dataset, or as an example in a portfolio or advertisement. No exception is granted to anyone.
• Use any content from this site in advertising or marketing for another dental practice or business, or in a way that suggests Dr. Bonifatto endorses, is affiliated with, or provided the work shown.
• Reproduce the text of the site in substantial part, or systematically enough to substitute for the site itself.
• Remove, obscure or alter any attribution, credit, copyright notice or watermark.
• Access the site by automated means in a way that degrades it for other visitors, ignores our robots.txt, or circumvents any technical restriction.
• Attempt to probe, scan or test the security of the site or its host, or interfere with its operation.
• Frame the site, or present it so that it appears to be part of another site.
• Use the site for any unlawful purpose, or to harass, defame or impersonate anyone.

Reservation of rights for text and data mining. Except for the permission expressly given in section 6 for the text, we expressly reserve all rights in this site's content for text and data mining, machine learning and AI training purposes, including under Article 4(3) of EU Directive 2019/790 and any equivalent provision elsewhere. The reservation over patient photography is absolute and is not waived by the general permission for text, nor by anything in our robots.txt.

8. Nothing here is an offer

Fee ranges, treatment descriptions and timelines on this site are general information about the market and about how the work is normally done. They are not an offer, not a quote, and not a binding price. No fee is fixed and no treatment plan exists until you have been examined in person and given something in writing.

9. Links to other sites

This site links to Summer Dental & Orthodontics, to social media accounts, and occasionally to third-party articles. We do not control those sites, are not responsible for their content, and their privacy practices are their own. A link is not an endorsement of everything on the other end of it.

10. Anything you send us

Do not send confidential material, clinical information, or ideas you expect to be paid for. Anything you do send is treated as non-confidential and unsolicited, and you grant us the right to use it without obligation to you. This does not apply to information you give the practice as a patient, which is confidential and protected by law.

11. No warranties

The site is provided "as is" and "as available". We work to keep it accurate and current and we correct things when we learn they are wrong, but we make no warranty of any kind, express or implied, that the content is complete, current, accurate, or fit for any particular purpose, or that the site will be uninterrupted or error-free. Dentistry changes, and pages age.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special or punitive damages arising from your use of this website or from reliance on its content, and our total liability arising out of the website is limited to one hundred United States dollars (US$100). You pay nothing to read this site, and that is the consideration the limit reflects.

This section is about the website and nothing else. It does not limit, waive, disclaim or affect in any way any liability arising from the provision of professional dental services, which is governed by Nevada law and by the standard of care, and which cannot be and is not being waived here. It also does not exclude liability for fraud, for willful misconduct, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, in which case the exclusions apply only as far as that jurisdiction permits.

13. Indemnity

If your misuse of this site, in breach of section 7, causes a claim against us, you agree to cover the reasonable costs of defending it. This is aimed squarely at commercial misuse of patient photography, not at ordinary readers.

14. Copyright complaints

If you believe content on this site infringes your copyright, write to us at the address at the bottom of this page with: your contact details, identification of the work you say is infringed, the URL where it appears here, a statement that you have a good faith belief the use is unauthorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for them, and your signature. We will look at it promptly.

This site hosts no user-uploaded content, so it is not seeking safe harbour under 17 U.S.C. 512. We simply want to hear about it and fix it.

15. Governing law and venue

These terms are governed by the laws of the State of Nevada, without regard to its conflict of laws rules. Any dispute arising out of this website or these terms will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the jurisdiction of those courts. Nothing in this section affects where a professional negligence claim may be brought.

16. Changes

We may update these terms. The current version always sits on this page with its effective date at the top. Continuing to use the site after a change means you accept the revised terms.

17. General

If any provision of these terms is held unenforceable, it is severed and the rest continues in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy and the Medical Disclaimer, are the entire agreement between us about this website. The Accessibility Statement is a description of our practices, not part of this agreement. You may not assign these terms; we may assign them to a successor.
